On May 6, 2008, the SEC filed this emergency civil enforcement action [SEC Complaint]. On that same day, US District Court Judge Lloyd D. George issued a Temporary Restraining Order and Orders; (1) Freezing Assets; (2) Appointing a Temporary Receiver; (3) Repatriating Assets; (4) Requiring Accountings; (5) Prohibiting the Destruction of Documents; (6) Granting Expedited Discovery; and an Order to Show Cause Re Preliminary Injunction and Appointment of a Permanent Receiver. After reviewing evidence submitted by the SEC, Judge Lloyd George found that good cause exists to believe that defendants have engaged in, are engaging in, and are about to engage in acts, practices, and courses of business that violate the anti-fraud provisions of the U.S. federal securities laws.
The SEC complaint alleges the defendants are operating a fraudulent investment scheme whereby they promise investors an 87.5% return on their investments, reportedly earned by foreign currency trading. The complaint alleges the defendants have not engaged in any significant foreign currency trading, but have paid investors their “profits” and commissions by using the funds from later investors to pay early investors in a Ponzi scheme. The SEC complaint also alleged the defendants have transferred millions of dollars of investor funds to their personal bank and/or brokerage accounts, as well as using investor funds for personal expenses.
Receivership InformationCook Receiver Services Inc. has been appointed by the Court as the Receiver for Gold Quest International Inc. The Order Appointing Temporary Receiver authorizes the Receiver to "take such action that is necessary and appropriate to preserve and take control of and to prevent the dissipation, concealment, or disposition of any assets of, or managed by, Gold Quest and its affiliates." The Receiver operates under the authority of the Court and reports to the Court.
This web site is created to provide information on the progress of the receivership to the victims of Gold Quest International. Relevant court filings and updates will be added periodically. In the event that sufficient assets are recovered to make payments to the victims, a notice and claim forms will be posted on this web site.
